Terms & Conditions
These Terms and Conditions govern all use of the NT Sport Horses (NTSH) website, services, training sessions, lessons, clinics, and any associated events. By booking, attending, or engaging with NTSH services, you agree to be bound by these terms.
1. General Liability and Risk Acceptance (Disclaimer)

1.1. Acceptance of Risk: All equestrian activities, including but not limited to training, lessons, clinics, and events, inherently involve significant risks, including the risk of serious injury or death to participants, riders, and horses.
1.2. Rider and Owner Responsibility: The participant/rider/owner acknowledges and agrees that they engage in all activities entirely at their own risk and are responsible for the safety of their horse, tack, and equipment.
1.3. Limitation of Liability: Nick Turner, NT Sport Horses (NTSH), the land owner(s), their respective employees, agents, or representatives (collectively, "the Organisers") shall not be liable for any direct, indirect, punitive, special, incidental, or consequential damages, loss, or injury to any person (including spectators), animal, or property, howsoever arising, including without limitation, lost revenues, or lost profits.
1.4. Indemnity: The participant agrees to indemnify and hold harmless the Organisers against all claims, actions, costs, and liabilities arising from their participation.

2. Bookings, Payments, and Cancellations

2.1. Booking Confirmation: A booking is considered confirmed only upon receipt of the full payment or a pre-agreed non-refundable deposit.
2.2. Participant Cancellations:
-
2.2.1. Full Refund: Cancellations received more than 72 hours (3 days) prior to the scheduled start time of the lesson, training session, or event will be entitled to a full refund.
-
2.2.2. No Refund: Cancellations received less than 72 hours prior to the scheduled start time will not be entitled to a refund. In this instance, NTSH reserves the right to offer the slot to another client.
-
2.2.3. Exceptional Circumstances: NTSH may, at its sole discretion, offer a transfer or credit note for cancellations due to veterinary or medical emergencies, provided a valid certificate or evidence is supplied within 48 hours of the cancellation.
2.3. Organiser Cancellation: In the event that Nick Turner or NTSH must cancel a scheduled lesson, training session, clinic, or event for any reason (e.g., adverse weather, instructor illness, venue unavailability), a full refund or a transfer to a future date will be offered to the participant.

3. Safety and Conduct

3.1. Riding Hats: All riders must wear a securely fastened, properly fitted riding hat that meets current safety standards (e.g., PAS 015 or VG1). NTSH reserves the right to refuse a rider without an appropriate hat.
3.2. Body Protectors: Body protectors are strongly recommended, especially for jumping activities, and are mandatory cross-country and for specific events.
3.3. Horse Fitness: It is the responsibility of the horse owner/rider to ensure their horse is fit, sound, and adequately prepared for the activity they are undertaking.
3.4. Code of Conduct: Participants must behave responsibly, courteously, and follow all instructions given by Nick Turner or NTSH staff/agents immediately. Dangerous or abusive behaviour towards people or animals will result in immediate removal from the premises or session without a refund.

4. Data Protection, Privacy, and Media

4.1. Confidentiality: All personal data (Name, Address, Email, Telephone No.) submitted at the time of booking will be collected, stored, and processed in accordance with the relevant data protection laws. This information will remain confidential and will not be passed on to any third parties unless required by law or for the completion of the booked service (e.g., providing a clinic entry list to a venue).
4.2. Payment Security: All payment card details will be handled securely. NTSH does not store sensitive payment information; third-party payment processors will be utilized in compliance with industry standards. Any physical payment records will be destroyed securely upon completion of the transaction.
4.3. Media Consent: By entering or attending an NTSH event, lesson, or clinic, you consent to NTSH using any appropriate photographs, video footage, or recordings captured during the session for promotional purposes on the NTSH website, social media, or marketing materials. If you object to the use of your or your horse's image, you must notify NTSH in writing prior to the session.
5. Social Licence to Operate and Media Usage
5.1. Ethical Conduct: NT Sport Horses (NTSH) is committed to upholding the highest standards of horse welfare and ethical practice, recognizing the crucial importance of the equestrian sport's social licence to operate. All participants must treat their horses and other animals with respect and compassion at all times.
5.2. Video and Sound Restrictions: To protect the reputation and training methods of NTSH, and in recognition of the sensitive nature of equestrian training, any video footage taken by participants during lessons, clinics, or training events MUST have the sound removed before publication. Furthermore, express written permission MUST be sought from NT Sport Horses before publishing any video, photograph, or recording (with or without sound) on social media platforms or any other public or private platform.
6. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
